The Government of Kenya (GoK) has received financing from the World Bank’s International Development Assistance (IDA) towards the cost of the Kenya Petroleum Technical Assistance Project (KEPTAP), and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include supporting GoK to develop Kenya Local Content Policy and Kenya Oil and Gas Local Content Regulations with the objective
(i) To Assist Ministry of Industry, Trade and Cooperative (MoITC) to develop a umbrella Local content policy that governs local content across multiple sectors and
(ii) To assist Ministry of Energy and Petroleum (MoEP) to develop Oil & Gas local content regulation.

The consultancy will run for a period of nine (9) Months equivalent of (36) weeks from the effective date.

The scope of the assignment will include:-

The work will be conducted at two Work Streams. Work Stream One is the Local Content Policy for MoITC; Work Stream Two is the Oil and Gas Local Content Regulations for MoEP. The Assignment scope includes;

i. Thorough stakeholder engagement with the public sector (central and county governments) and private sector to ascertain the challenges for developing facilitative legislation acceptable to a broad spectrum of stakeholders.
ii. indicate the strategies required surrounding local content policy and oil and gas regulations to offset legislative inconsistencies;
iii. Identify major pitfalls to help to optimise local content and facilitate sustainable economic growth and efficient delivery of oil and gas and other large projects;
iv. Develop criteria for the establishment of joint ventures that meet the requirements of local content and FDI policy and regulations;
v. Assist GOK to optimise local content across multiple sectors by establishing a consistent framework of policies and legislation that do not conflict with Kenya’s regional and international agreements and contribute to Vision 2030;
vi. Indicate strategies for transfer of technology , knowledge ,skills research and development and to encourage growth of local manufacturing sector to produce oil and gas related goods

Deliverables include:-

The deliverables of the Consultant in extensive working relationship with the Technical Committees are:

i) Inception report – overview of how the project will be completed, including timeline, geographic scope, etc. This should include a draft research methodology, based on a literature review.
ii) Draft report for Local Content Policy and Oil & Gas Regulations.
iii) At least four multi-stakeholder workshops.
iv) One validation meeting.
v) Final report (in English, in hard and soft copy).

MoITC now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services.

The consultants should have the following skills and experience:-

a) Demonstrated experience in carrying out similar work in the oil & gas sector;
b) The consultant must demonstrate ten (10) years’ experience of developing Oil and Gas Local Content Regulations.
c) The consultant must demonstrate significant experience in the development of Local Content Policy (or relevant and similar).
d) Appropriately qualified and skilled personnel with relevant experience
e) The consultant to provide no more than three (3) examples of experience in the last ten years of relevant assignments with evidence of delivery for both work streams.
f) Demonstrate proven experience in Africa.

The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines:
Selection and Employment of Consultants [under IBRD Loans and IDA Credits & Grants] by World Bank Borrowers January 2011 (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.

Consultants may associate with other firms in the form of a joint venture or a sub-consultancy to enhance their qualifications.
A Consultant will be selected in accordance with the Quality & Cost-Based Selection (QCBS) method set out in the Consultant Guidelines.

The Completed Expression of Interest and accompanying documents must be submitted by Tuesday, 18th July, 2017 at 10.00 hrs (East African Time) in plain sealed envelopes and clearly marked “EXPRESSION OF INTEREST (EOI) FOR LOCAL CONTENT POLICY AND OIL & GAS REGULATIONS” and should be mailed or deposited in the Tender Box provided on the 16th floor NSSF Building, Block A, Eastern Wing, addressed to;
